1) Acceptance of Terms

By downloading, accessing, or using Kalon (“the App”), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.

2) Service Description

Kalon uses AI to analyze your inputs and suggest habits, routines, and tasks to help you achieve your goals through a 66-day consistency plan. The App provides guidance and tools; your results depend on your implementation and circumstances.

3) Eligibility

You must be at least 13 years old to use the App. If you are under the age of majority in your jurisdiction, you must have a parent or legal guardian’s permission and supervision.

4) Account & Responsibilities

You’re responsible for:

• Providing accurate information and keeping your login secure.
• All activity under your account.
• Using the App only for lawful purposes and in compliance with these Terms.

5) Health, Fitness & Professional Disclaimers

Content in the App is for informational purposes only and is not medical, mental-health, legal, financial, or professional advice. Consult qualified professionals before starting or changing any health, fitness, or lifestyle routine. If you experience an emergency, call local emergency services.

6) Subscriptions, Trials & Billing (if offered)

• Prices, features, and trial durations are shown at purchase. Trials convert to paid plans unless canceled before the trial ends.
• Apple App Store Purchases: Billing, renewals, and refunds are managed by Apple under the Apple Media Services Terms. Manage or cancel in Settings > Apple ID > Subscriptions on your device. Fees are charged to your Apple ID and auto-renew unless canceled at least 24 hours before the current period ends.
• Taxes may apply. We may change prices with prior notice where required.

7) License & Intellectual Property

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App for its intended purpose. The App and all related content, trademarks, and technology are owned by Kalon66 App or its licensors and are protected by intellectual-property laws. You may not copy, modify, distribute, reverse engineer, or create derivative works except as permitted by law.

8) User Content

You retain ownership of content you enter (e.g., goals, routines, notes). You grant Kalon66 App a worldwide, non-exclusive, royalty-free license to host, process, and use your content solely to operate, improve, and provide the App’s features.

9) Acceptable Use

You agree not to:

• Use the App for any unlawful, harmful, or fraudulent purpose.
• Interfere with or disrupt the App or its security.
• Attempt to access the App using automated means (scrapers, bots) without permission.
• Upload malicious code or violate others’ privacy or intellectual-property rights.

10) Third-Party Services & Links

Some features may rely on third-party services (e.g., cloud hosting, AI processing, analytics). We are not responsible for third-party terms or content. Your use of third-party services is governed by their terms and privacy policies.

11) Termination

We may suspend or terminate access to the App at any time if you violate these Terms or if required for legal or security reasons. You may stop using the App at any time; deleting the App does not automatically cancel a subscription purchased through Apple (manage in device settings).

12) Disclaimer of Warranties

The App is provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the App will be uninterrupted, error-free, or that results will meet your expectations.

13) Limitation of Liability

To the maximum extent permitted by law, Kalon66 App and its affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of (or inability to use) the App. Our total liability for any claim will not exceed the amount you paid to us (if any) for the App in the twelve (12) months preceding the event giving rise to the claim.

14) Indemnification

You agree to indemnify and hold harmless Kalon66 App, its affiliates, and personnel from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the App or violation of these Terms or applicable law.

15) Updates to the Service & Terms

We may modify or discontinue features at any time. We may update these Terms from time to time; continued use after changes means you accept the updated Terms. If changes are material, we will provide notice (e.g., in-app or email).

16) Governing Law & Venue

These Terms are governed by the laws of the State of Utah, USA, without regard to conflict-of-law rules. Courts located in Utah County, Utah shall have exclusive jurisdiction, except that you and we may seek injunctive or other equitable relief in any court of competent jurisdiction.

17) Apple-Specific Terms

You acknowledge that: (a) these Terms are between you and Kalon66 App only; (b) Apple is not responsible for the App or its content; (c) Apple has no obligation to provide maintenance or support; (d) in the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); and (e) Apple and its subsidiaries are third-party beneficiaries of these Terms with the right to enforce them against you.
